Helping You to Understand the
Party Wall etc. Act 1996 and How it Affects You!

Party Wall etc. Act 1996 replaced the old London Building Act and extended it’s legislation and procedures to the whole of England and Wales. If you are a property owner looking to carry out an extension, a loft conversion, a basement conversion, a new build or any structural alteration to your property which is covered by the Act, you will have rights to do so and obligations to your neighbouring owners. Whilst the Act cannot stop the building work from going ahead it is also there to safeguard the interest of the neighbour (the Adjoining Owner) and their property. Below is a brief description of the building works that are notifiable under the Act.

What Works Are Notifiable?

SECTION 1 NOTICE

Covers New Walls or Foundations Built Up To or Astride The Boundary (Line of Junction)

Should your building work include a new wall or foundation built up to, or, astride the Boundary (Line of Junction), you are obliged to serve a Party Wall Notice upon the neighbouring owners affected by the works. 

As Specialist Party Wall Surveyors we can advise you on the works that will require Party Wall Notice(s) to be served on your neighbours & prepare and serve Party Wall Notice(s) on your behalf for a Fixed Price Fee.

SECTION 2 NOTICE

Covers Work on a Party Wall or Party Structure - Often a Shared Wall Between Two Properties or a Floor Separating Two Flats

Should your work include work on a party wall or party wall structure between two properties or a floor between two flats, you are obliged to serve a Party Structure Notice(s) upon the neighbouring owners affected by the works.

 

As Specialist Party Wall Surveyors we can advise you on the works that will require Party Wall Notice(s) to be served on your neighbours & prepare and serve Party Wall Notice(s) on your behalf for a Fixed Price Fee.

SECTION 6 NOTICE

Covers Excavations Within 3 or 6 Meters of an Adjoining Owner’s Property to a Greater Depth Than Their Foundations

Should your work include excavations within 3 or 6 meters of an adjoining owners property to a greater depth than their foundations, you are obliged to serve a Party Wall Notice upon the neighbouring owners affected by the works.

 

As Specialist Party Wall Surveyors we can advise you on the works that will require Party Wall Notice(s) to be served on your neighbours & prepare and serve Party Wall Notice(s) on your behalf for a Fixed Price Fee.
