  • Reviewing your drawings to identify the Party Wall Notifiable Works and to ascertain which Notices need to be served under the Party Wall etc Act 1996.

  • Carry out a Title Registry search of the adjoining properties.

​

  • Preparation of a Professional Notice(s). Your neighbour will also be invited to contact us at Berry Party Wall Surveyors should they have any questions in relation to the Notice(s).

​

  • Acknowledgement Forms and a stamped addressed envelope for your neighbour to formally respond.

​

  • Selection, collation and inclusion of your necessary drawings to ensure the Notices served are valid.

​

  • We will serve all required Notice(s) on your neighbours within 24 hours of receiving a Letter of Appointment and all necessary plans & sections.

Agreeing to a Schedule of Condition Survey

SCHEDULE OF CONDITION

  • When we inspect the Adjoining Owners home (your neighbours) we make a detailed report of the existing condition of the property that could potentially be affected by the work, taking careful note of any existing damage or cracks. The reason for doing this is so that claims cannot be made afterwards that the proposed building works are responsible for pre-existing defects to your neighbours property.

​

  • A Schedule of Condition Report will then be prepared in duplicate, one for you and one for your neighbour. This includes references to the photographs held on file and a detailed description of the current condition of the property.

​​

  • PLEASE NOTE : Without a  Schedule of Condition it is very difficult to defend a claim that the building works have caused damage to the adjoining property (or properties)!

Agreed Surveyor

If your neighbour "Dissents to the Work" you are then deemed to be ‘in dispute’ and a single Party Wall Surveyor, otherwise known as an ‘Agreed Surveyor’ can be appointed, in accordance with the Act. With this option we would be appointed to act impartially for both parties as the Agreed Surveyor. 

 

As the Agreed Surveyor, we would prepare a legal document called a Party Wall Award which provides a binding framework to ensure the works covered by the Act are planned to be carried out in a diligent way and give a means of recourse if problems occur.

 

The Award settles the ‘dispute’ in a way that protects both owners’ interests, but still enables the works to proceed in a reasonable time frame.

 

A Schedule of Condition would be carried out with this option automatically.​

BUILDING OWNERS SURVEYOR

If your neighbour "Dissents to the Work" and would like to use their own independent Party Wall Surveyor we would be happy to act for you as the Building Owners Surveyor and are able to offer competitive prices per Adjoining Owner.

 

As the Building Owners Surveyor, we would work alongside your neighbours appointed Surveyor to resolve the "dispute" and prepare a legal document called a Party Wall Award which provides a binding framework to ensure the works covered by the Act are planned to be carried out in a diligent way and give a means of recourse if problems occur.

 

The Award settles the ‘dispute’ in a way that protects both owners’ interests, but still enables the works to proceed in a reasonable time frame.

 

A Schedule of Condition would also be carried out automatically with this option too.
